John Gonya, sorry your event wasn't better attended, obviously there is much less of a population this time of year. I understand the reasons you had this seminar in October (free materials etc). I'm sure a lot more of us would have liked to attend, including my family. If you would like to include my area in the neighborhood watch I would be glad to oblige. This time of year is hit or miss for most of us, although I think its one of the nicest times of the year up here. We appreciate all the efforts you have put forth this year. Thanks for a very safe summer.

Thank you to all who attended the Safe Communities event at Town Hall on the 4th.  I will plan another event for early summer 2009 to reach a larger crowd.  I had to hold this event in October due to it being crime prevention month and it allowed the town to receive all of the materials for FREE.  You will hopefully see signs marking this community as a "Neighborhood Watch" area in the near future.  I am also looking in to making Clear Lake a "Meth Watch Community" to let the drug users know they are not welcome here.

Again, thank you to those who were able to make it and I hope you all enjoyed the presentations.  Thank you Mr. Oldsen for the nice comments.

Thanks John Gonya! An excellent presentation yesterday, its unfortunate that more folks didn't take the time to attend. For those of you who missed the informative session at the Town Hall we learned a lot about the drug issues here in Steuben County (as well as others), the new Neighborhood Watch Program, a K-9 demonstration, and lastly the Steuben County "SWAT" Team. All the presentations were extremely informative and appreciated.

Looking for a Clear Lake cottage for the winter. Do you have a cottage that you keep heat on all winter, but you don’t use, till spring? My Mom owns and I have been through one appeal hearing and just am interested to share information, ideas & possible strategies to put a stop to this "taxation without fair representation". While I had certainly lost touch with Jerry since I left Indiana, it was not for lack of desire. Time goes on, life starts and suddenly you are consumed with family, job, mortgage etc... but news like this definitely brings it back around to the good times once had. I will certainly miss Jerry and the crazy adolescent time spent growing up on Clear Lake. Some memories to make some smile during this time: island parties before they (we) were legal, going to the Yacht Club dances in the boat, a left over keg in the back of the Ski Tique (sorry Mr. Deitrich), seven people in the 912, lap after lap after lap of Lake Dr., missing curfew because of some crazy idea Jerry had... I could go on and on but through it all Jerry was the first, last and loudest to laugh. He will be missed.

I am still in disbelief and very saddened about Jerry. As time flies... Jerry, Jeff Bokel and I were inseparable and the best of friends 10 years ago. Some of my favorite memories of Clear Lake were because of those two and all the lake fun we easily ventured into. Jerry's sense of pleasantry was compared to no others- he could roll the funniest things off his tongue that always kept laughter continuous throughout the evening. We would drive around the lake listening to the entire “Little River Band” CD and he would sing every word verbatim. I always think of that memory when I hear those songs.
          My prayers go out to the family and friends, whom will fell this loss, and with all my certainty, he is in his bass boat in heaven and in the only, other most beautiful place then Clear Lake this very minute. I am very sorry for this heartbreaking loss and will hold my memories of our friendship even closer at this time.

****REMINDER****

The "Clear Lake Celebrates Safe Communities" event will be this Saturday, October 4th, from 10:00 a.m. to 1:00 p.m..  I will have information on Neighborhood Watch programs, Crime Prevention information, and tips on keeping your home safe year round.  There will also be an investigator from the IMAGE Drug Task Force on hand to do a presentation and answer questions about drugs, specifically Methamphetamine.  Clear Lake is not immune to this problem so I have asked for a presentation on what to watch for with meth labs.  There will also be a K-9 unit on hand that will do a demonstration and a member of the Special Response Team to show off some equipment they use when the enter these meth labs.

I hope to see everyone there!  I would also like to get some volunteers for starting up the neighborhood watch program in each ward and having block "captains" for each area.  See you there.

Dear Fellow Lakers,

I am Jerry Dietrich's oldest sister.  I want to thank everyone for their prayers and concerns during this traumatic time in the lives of my family and all those who knew and loved him. Our family is holding on with the Lord's strength and through the memories and stories some of you have shared with us.  Thank you.

Jerry loved this lake and had many great memories growing up here.  No one could find a turtle or a snake as quickly as he could and I am certain he knew all the great fishing spots...sorry, apparently a good fisherman never tells his secrets! Of course, what I will remember most about my brother was his wit, sense of humor and his giving nature. And every time I look out onto that beautiful lake, I will remember the treasured son, brother, uncle and friend who will be sorely missed.

I received word this morning that fellow laker and friend Jerry Dietrich died last night from his injuries sustained while at work this past week. We are very saddened with his passing. Tom Wehrenberg was instrumental in providing Swim Buoys around the lake and I am sure this has prevented injury and possibly death. On the South Side of the lake there is a long stretch without Swim Buoys, very dangerous. Before we have our Swim Buoys out in the lake boaters will come very close to our dock and will miss seeing any swimmers.

Sad news about another one of our own. Jerry Dietrich was involved in a tragic mowing accident on a golf course in Fort Wayne Indiana. He was life-flighted on Wednesday after being pinned under a commercial mower in a pond on the course. He is in Park View Hospital in an induced coma. Please have Jerry and his parents Mr. and Mrs. Ronald Dietrich and family in your thoughts and prayers during this very difficult time.

Clear Lakers: While many of us are still reeling from the shock of losing our friend and community leader, Paul Federspiel, this may be a fitting time to explore and enjoy those special areas preserved through the work of the Clear Lake Conservancy.  Kasota Island, Koeneman Lake and Spangler Grove are three examples of land that has been purchased or generously donated and placed under the protective umbrella of the Clear Lake Township Land Conservancy.  Paul and other conservancy leaders before him, current and past board members and several generous land donors  have acted to protect green space and environmentally sensitive areas around the lake from further development.  Thanks to their leadership, collective wisdom and foresight these protected lands will remain in their natural state for current and future generations to enjoy.

With such a gorgeous week-end in the weather forecast, this is a perfect time to get out and reap the benefits of these gifts from our land conservancy. Take a walk though any of these preserved areas and know how blessed we are to have such preserved beauty surrounding us.

It has been suggested that a group might want to meet on Kasota Island Friday ( Sept.26) at 5:00 PM to individually enjoy the beauty of the island and to collectively gain some closure on Paul's death by sharing  some memories of him in an area he was so significant in preserving. If you would like to participate but your boat has been put away for the winter, meet on the Yacht Club dock by 5:00.  Others with boats still in the water will be circulating by to give you a ride to the island.  If a trip to the island doesn't work for you, then enjoy one of the other conservancy area with thoughts of Paul on a Job Well Done.

Those with boats in the water who are planning to meet at the island, invite anyone who you think might want a ride and meet on the north side around 5:00.  We can take turns circulating by the Yacht Club dock if others want to join in.  The 5:00 time should allow anyone to join us and still have time for other evening activities.

CLEAR LAKE — Paul Robert Federspiel, 61, died Saturday, Sept.20, 2008, at his home in Clear Lake.

Mr. Federspiel retired as vice president and commercial loan officer of Fort Wayne National Bank in 1999 after 33 years of employment. He provided leadership and direction for the Clear Lake Township Land Conservancy. He had a deep love and passion for Clear Lake and the land surrounding it, including Kasota Island.

He was a member of the Clear Lake Town Council, the Clear Lake Planning Commission and the Clear Lake Lions Club and was the current president of the Clear Lake Township Land Conservancy Inc. He was also a former board member of the Big Brothers and Big Sisters of Fort Wayne and was a dedicated community volunteer.

He was a 1965 graduate of Central Catholic High School in Fort Wayne and attended Indiana University, Bloomington campus.

He was married to Kathleen “Kathy” Latz. She survives.

Also surviving are his parents Robert P. and Margaret A. “Meg” Federspiel, and five siblings: Phillip Federspiel, Ellen Poffenberger, Susan Chase, Neil Federspiel and Ann DeWert.

No public visitation or service is planned.

Clear Lake Friends and Neighbors,

We are appealing to everyone within the Fountain Beach Property legal description on your 2008 Real Property Tax statement.  We encourage you to appeal your tax liability in protest of the grossly overstated land value.  None of us would argue that our property value has appreciated significantly, but what is a fair assessment of that appreciation? We disagree with the current evaluation system.

Attached you will find Form 130 - Petition for Review of Assessment by Local Assessing Official to appeal your property taxes.  We have also included Form HC10 - Claim for Homestead Property Tax Credit.

Our land value is the highest on the lake at an average of $540,000. Visit http://www.in.gov/dlgf/4931.htm to search addresses around Clear Lake and you will see that our values are far and above everyone else. For example, a typical value for a lot on Island View Section is $280,000.  Property value on Point Park, where there are several new large homes, is $375,000.  Fountain Beach 1ST Addition is $318,000.  East Bay Park is $214,000.  These are just a few examples of the land values around the lake. 

You have 45 days to appeal from the date the taxes were mailed.  Most were mailed on August 18, 2008.  We need to hurry!  If we Lakers show our dissatisfaction with the current system, maybe we can get it changed.  We do not believe we are alone in this.  Urge your friends and neighbors, no matter what area of the lake they live on, to appeal.  There is more power in numbers.

 One other tool we have used to show justification for the appeal is an independent appraiser.  Mike recommends Matt Kruse of Putnam Kruse Appraisal Group http://www.pfkruse.com.  You can contact Matt at 260-665-2274 or 260-414-2020.  Matt’s father is Dennis Kruse, Indiana State Senator, District 14.  Don’t delay sending in your appeal form.  If you choose to get an appraisal, you can send it in later.

Mr. Disser, I believe you are correct on the distance between watercraft being operated at speed. However, I am still learning the boating laws and have to lean on the DNR for some questions. Dear Mr Gonya Town Marshal, I didn't get to meet you over the summer but heard many good things about you. Law and order on Clear Lake are part of what has made the Lake what it is today. Thank you. In the past, (way past, like the '60's) I remember reading boating regs for CL. At that time I believe 200' was the required distance between watercraft operating in open water at speed. If that still applies, some people need a reminder of what 200' looks like. I think I aslso remember that at that time it was "illegal to launch or allow be launched on Clear Lake any watercraft containing a marine head or permanent berths. Is that true today ? No particular reason for the question, my brothers and I were talking old time CLlast summer and this came up. Thanks again for your service to the Town John K. Disser

What a beautiful morning. While in the hot tub this morning Ron & I watched the Ospey as he circled and dove into the water for fish. He was finally successful about 5 minutes ago (8:45am) and is now on the east side of the island in the dead tree eating his catch. He had a difficult time getting airborne with the fish in his claws, but managed to get to the island. Our rain gauge in the vineyard had 3.25" for Friday night Saturday and 1.75" for Sunday.

Art, as Robert and Curt reported Clear Lake was somehow spared from the 6" plus rain we were forcasted. Most of the rain pushed north. I talked to a friend today who lives on Coldwater Lake, he said they had more rain then Clear Lake and south. He saw two covered pontoon boats free floating about a hundred yards apart on the main part of Coldwater lake last evening. Seems everythings fine at Clear Lake.

Kudos to the law enforcement efforts this summer. You were very visible on the road and the water. A suggestion for next year--perhaps patrol the water more around dusk. It seemed as though many were on the water skiing, tubing, speeding at that time of day--a danger to pontooners and fishermen as well as themselves.

Low boat lift alert. (unofficial) If you cranked up your boat lift bringing your boat just above the water level of recent times, you may want to head back to the lake, (if you don't live there) and crank it up further, especially pontoons. With the 6 inches plus of rain we will be getting from this system, the lake may raise more then a foot, floating off many boats and pontoons off their lifts. Just a heads up.

Fox hound and a black lab were found at 496 lake drive Sept 4. The fox hound had an orange collar and number which came from Hillsdale Humane society. The dog had been relocated around the Detroit area. The black lab had a black collar with no information. The black lab was beautiful and probably a year or two old with a great temperament. To Nedine Buchhop ...  Actually the tax rate for schools went down this year from last. 

Maybe the Fremont Schools as percentage of your total taxes it went up?  Or the value of your property in relation to all properties changed?

Taxes are calculated by taking the total funds requested by a taxing unit (i.e. Fremont Schools), approved by the state,  and that amout is divided it by the total assessed valuation.  The valuation of your property is then compared to the total valuation.  Your % of the total (tax rate times valution = tax charged) is the tax that you are charged.

The Clear Lake Police Department will be sponsoring a Celebrate Safe Communities event at the Town Hall on October 3rd.  There are many activities being planned for the event that will include several different functions of public safety.

This event will focus on Neighborhood watch programs and keeping your home safe year round.  Resident's will be provided with information on how to be involved in a Neighborhood Watch program.

The Sheriff's Department SWAT team will be on hand for a demonstration of their equipment.  There will also be a full K-9 demonstration.  The Fremont Fire Department is invited to demonstrate their equipment as well as the Steuben County EMS.

As John Schenkel said in his posting, different platted subdivisions have VERY different assessments per lake front foot. You can check out your assessment (and anyone on the lake) by going to co.steuben.in.us Click on GIS online, go to Steuben County,IN, (property search will have a circle by it), and Enter. Steuben County GIS

Here you can key in a name and click on Search, or you can key in an address and click on Search. When you locate the property, click on the Parcel ID number and you will get lots of information. The 4th category down is "Land-Accessor's Office". The Base Rate here is the assessment per lake front foot.

I also had a call from another Clear Laker yesterday who is justifiably upset over the complete arbitrainess of the assessment system in this County that is based on platted subdivisions around the lake, and not on the lake as a whole. Neighbors it seems differ in front footage assessments by almost $5000 per front foot because one is in one subdivision and the other in an adjoining one. This whole thing is a mess right now!

I'll add a little more to this discussion.  In checking property taxes for homeowners claiming a homestead credit on their CL home their property taxes went down appx 30-40%. 

For those who did not claim the Indiana homestead credit or are not eligible (erg non-Indiana resident), the drop was less that 1% assuming that your assessed value did not increase. 

Since 2007 was a reassessment year in Indiana many property's values were adjusted up (or brought closer to market value).

John, mine also went down in Fort Wayne for primary residence.  As I understood it, the "relief" is targeted differently to second/rental homes, agriculture, businesses, etc.  Primary residences, or those that qualify for mortgage exemptions (whether taken or not), can trigger the cap of 1% of assessed value in 2010 (1.5% in 2009).  I don't know what the trigger actually was for 2007 pay 2008.  I think second homes/rentals will be 2% and businesses 3% in 2010 (2.5% and 3.5% in 2009) which won't be triggered often, because of the inherently high values of lake property.  A second home assessed at $500k would be roughly capped to $10k taxes at 2% in 2010, which is probably higher than what is being paid now. 

Many also saw a big 2006 pay 2007 increase due to the court mandated change to "market valuation" method prior to the talk of relief.  Lake property assessed values were apparently quite out of line with market valuation before since they moved faster than market over time.  There was also a 4-year re-assessment change in 2003 pay 2004 that hit us pretty hard (70% almost 1.7x).  Overall, ours increased 150% or 2.5x from 2003 to 2007, though no improvements were made to our property during that whole time.

Out of curiosity, I spot checked a few properties within the county that were primary residences, using the Steuben County GIS public records system, and those apparently did go down significantly for 2007 pay 2008, just as in Allen County.  So most are probably happy, except second lake home owners.  For us, based on the new plan, I don't expect the 2009 and 2010 phase-ins to make them go down either.

My tax bill in Fort Wayne went down this year 32%. I talked to the Steuben County Auditor and Assessor, and the answer I got was something like--well it IS lake property! I think it is interesting that in almost all of the surrounding newspapers, there are numerous articles about the homeowner taxes going down except there has been no such article I have found for Steuben County. How they managed to keep the taxes up while everyone else has gone down is a mystery to me. I would like an insight if anyone has some real good inside information. 5

While listening to the WANE morning news, I once again heard the phrase "property tax relief". Apparently, this phrase does not apply to Clear Lake property owners. What a jump!!! And how were the taxes computed? Some had no increase, some a slight jump, and others an exorbitant increase. And I can't understand how our lakefront footage is worth $5000 (per foot) more than our next door neighbors. We must have a better quality of sand. Does anyone truly know the logic--and I use the word loosely--of this? One more rant--thanks to the state for the short notice of when taxes are due.

CLMPSC’s work is reflected in the proposed draft of the new zoning ordinances linked to this notification.

An informal public question and answer session with the CLMPSC and Ground Rules, Inc. is scheduled for Monday, August 11, 2008 at 5:00 PM at the Town Hall. The committee and Ground Rules will explain the process they used in constructing the draft and will answer questions relating to the document.

On Saturday August 23, 2008 a formal Public Hearing will be held at which suggestions and recommendations will be accepted from the public.  That hearing will take place at St. Paul’s Catholic Chapel at 9:00 a.m..

Everyone is cordially invited to attend both sessions.  The formal Public Hearing is a critical 1st step in the process of adopting the new Zoning Ordinances.

My connection to the era of the mid 1800's is a Quarter. When I was swimming in the lake in approximately 1963 to 1965 and found this Quarter in the sand on the bottom within 10' of shore. I figured it was nothing special. Here it was dated 1853. Dad, Denver Eckert originally at Cottage #350, took it to a coin dealer and they said then that it was valued at about $35.00 if I recall. My last check on it was 20 years ago and then it was worth about $85.00.

Maybe it's time to take it back in to see how much it's worth now as I still have it locked away for safe keeping. As to the Cementary at Lake Anne, a close friend of mine lives on Lake Anne on the east shoreline. His name is Mike Ricica and has been on Lake Anne for close to 50 years. He might know something on this. Alan

Just to add some color to the Burying Grounds story, some of which may be true since my memory is not what it used to be---When I was growing up at Clear Lake in the late 40's and 50's, one of my best adult friends was "Mac" McCarthy who lived at 790. He was a great story teller, and had some real credibility with me since he would take my friend Rick McMeen (then of 884 and we were of 888) to the Salsbury fields to the South and hunt for and find all kinds of Indian arrow heads. He also took us over to Lake Ann to the "Indian burial grounds" which were on the north east side of the lake on top of a hill in the woods and hunt for arrowheads.

Mac was a WWII vet who had lost a leg, and in those days NOBODY ever locked doors. Rich had a hip bone issue and was on crutchs and needed braces for his leg. With that kind of empathy between those two, Rich and I would visit Mac sometimes before he got out of bed in the morning-yes I was a morning person even then. Mac had three different artificial legs-one was a peg, one was really beat-up and for everyday use, and the third (still really crude by today's standards) was his Sunday leg, and we would hide all of them THEN wake him up. I'm sure that's where I learned new and colorful language. Anyway, he always put up with us, and I still have arrowheads that foster the most fond memories of Mac and Rick and I tramping all over the places around Clear Lake.

At 6:30 this morning my husband heard a noise and looked to see that a flower pot on our deck had been knocked over. It had been knocked over by a deer that was standing in the water right in front of our sea wall looking up at our house. He was a young buck and had very short antlers. After standing there in the water about 10 minutes he started swimming toward the middle of the lake. We saw a fishing boat with two men in it heading toward the deer. They "guided" the deer across the lake to the point where Winches live. The men got off onto Winches dock, and we assume that the deer got out of the water there and took off. The men took off in their fishing boat after watching for a while, and we assume they watched the deer until it was out of sight. I have been here since 1963 and have only seen deer in the lake one other time!

NEWS RELEASE: On Friday July 18th, Officer's Compton and McCarty served a warrant on James McBride (Pat's son) in Fort Wayne. McBride is being charged in connection to several burglaries in Clear Lake and around the county. McBride is also a suspect in several crimes in Dekalb County. After an extensive interview, McCarty and Compton returned to Fort Wayne with a State Police detective and Fort Wayne PD and recovered some of the property from the crimes. This investigation is ongoing and will hopefully yield more property and more charges on those involved. During the interview, it was learned that several suspects have been in the Clear Lake area to steal whatever they can get their hands on. Please keep your house and outbuildings locked. We will continue to remind you if we find doors open at night. Also: Keep an eye out for a brown or maroon 1990's GMC truck, possibly occupied by two females in their 20's. They are suspected of stealing mail out of mailboxes in the northeast part of the county. There has been one report of it on Clear Lake. I will keep you updated. John Gonya

I have had a lot of questions concerning golf carts. Here is the police department's take on the issue: Golf carts will be allowed on Clear Lake town streets as long as the driver is at least 15 years old with a picture ID. The cart is supposed to have a slow moving vehicle sign on the back (orange triangle) and a red light on the back that can be seen from 500 feet. If someone is found being reckless or dangerous on a cart, it can be impounded and the driver cited. Please use good common sense when operating and DO NOT go out on the state highway or county roads.

My Grandpa Hughes (mom's dad) had 902 Lake Drive, when I was a kid, and mom got us (me and my two younger brothers) up to Clear Lake pretty frequently, even a few times in the winter. My great-aunt Hartman still has 750 Lake Drive. I keep casually looking for a place of my own, there, because I have such wonderful childhood memories of Clear Lake, and I want my wife and two-and-a-half year-old daughter to have them, also. As it stands now, I'll rent a cottage (#915 is great, but it's #804, this year, 7-5 through 7-11), for a pre-planned week, but if it's short notice and/or brief, the Clear Lake apartments has also been great, and very helpful. I hope I don't make anyone nervous if I'm driving around REALLY slow in my white neon with a black roof (long story), but I never want to leave, and I want to take in as much as I can before I have to go. Everyone take care!!

Attention Clear Lake residents: On Wednesday night, the Police department recovered a large water trampoline that has reportedly been stolen from Clear Lake. It is unknown when the theft occurred but it is connected to the break-in's over the winter.

If you know someone who owns a water trampoline and has not put it out yet or has one missing, please contact them to make sure they still have one. If the victim is located, please have them contact me at 495-9620.

There is also a suspect vehicle that may still show up in the area. Please watch for a purple Ford Ranger with "In God We Trust" plates of ZD1695. Call 911 immediately if you see this vehicle so we can track him down. I will notify you via the bulletin board as soon as I can get him in custody.

For those who were not at the meeting Monday night, the Police department has coloring books available.  The Clear Lake Association teamed up with the Police Department and purchased online safety coloring books.  The books are filled with saftey tips for kids who go online and on the back there is a website that the kids can sign up for their club and play more games.

A public hearing is scheduled for Monday, June 9, 7 P.M. at the town hall regarding fireworks and animal control, along with a few others. A summary of the two major ordinances has been posted on the Town's web site for review and comment on Monday. The Town invites input, and e-mail can be sent through the Town's site. The town of Clear Lake used to put the minutes of their various meetings on line. However there have been no minutes since 2007 for town council, board of zoning appeals, and plan commission. These minutes were one of the ways that those of us that don't live at the lake full time could keep up on what's happening with our local government. I for one would like to see them kept up-to-date.
